Turkey Issues New Regulation on Market Surveillance and Inspection for Distance Selling of Goods

The Ministry of Trade of Turkey issued the Regulation on Market Surveillance and Inspection of Products Supplied on the Market via Remote Communication Tools. The document appeared in the Official Gazette dated October 30, 2024 and numbered 32707.

The Regulation sets:

  • the procedures and provisions regarding market supply conditions and sales advertisements of products that are sold via the Internet, telephone, and email
  • the responsibilities of suppliers that place their products on the market via remote communication tools
  • market surveillance procedures and principles

 A product can be placed on the market via remote communication tools in the following cases:

  • The product meets the relevant technical regulations or the General Product Safety Regulation
  • The targeted end end users are residents of Turkey

In case of selling over the Internet, the domain name must be registered in a geographical area where shipping to Turkey is possible.

The economic operator must include the following information in sales advertisements and prior tothe end user purchasing the product:

  • Name and registered trade name, postal and email address
  • The name, registered trade name or trademark and full address of the manufacturer of the product resident in Turkey;
  • If the manufacturer is not resident in Turkey, the importer’s name, registered trade name or trademark, postal and email address;
  • Warning and safety information and signs of conformity in Turkish;
  • Additional identification information of the product.

The Regulation introduces many new obligations for suppliers and set additional responsibilities on intermediary service providers and performance service providers.

If economic operators sell or mediate the sale of products from abroad to persons in Turkey then they also require to comply with the Regulation.

The Regulation becomes effective from April 1, 2025
